TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the Brandiket website and services. Brandiket is the DBA of Nex Brand Marketing (“Company”).


1) Agreement to Terms

By accessing our site or purchasing services, you agree to these Terms and any proposal, order form, or written agreement you enter into with the Company (collectively, the “Service Agreement”).


2) Services

We provide marketing and creative services including (as applicable):

  • Website design/updates and conversion improvements
  • Local SEO and Google Business Profile optimization
  • Paid advertising management (Google Ads, Meta Ads, and others)
  • Email and social content creation/posting (based on tier)
  • Reporting and performance reviews

Services and deliverables are defined by your tier, add-ons, and written Service Agreement.


3) Ad Spend and Third-Party Fees

  • Ad spend is paid directly to ad platforms (Google/Meta/etc.) unless otherwise stated in writing.
  • Third-party costs (printing, subscriptions, call tracking tools, stock assets, rush fees) may be billed separately or paid directly by you.

4) Client Responsibilities

You agree to:

  • Provide accurate information, access, and approvals promptly
  • Maintain compliance with applicable laws and industry rules
  • Provide or approve brand assets, offers, and service details
  • Pay invoices according to the Service Agreement

Delays caused by missing access/approvals may pause timelines and deliverables.


5) Acceptable Use

You agree not to use our website or services to:

  • Violate laws, regulations, or third-party rights
  • Transmit malicious code or attempt unauthorized access
  • Make deceptive, unlawful, or misleading claims


6) Intellectual Property

  • You retain rights to materials you provide.
  • We retain ownership of our pre-existing tools, templates, processes, and know-how.
  • Upon full payment, you receive a license to use final deliverables for your business.


7) No Guarantee of Results

Marketing performance varies. We do not guarantee rankings, revenue, lead volume, or specific outcomes. We do guarantee delivery of the work described in your tier/add-ons and Service Agreement.


8) Term, Billing, and Cancellation

Minimum Term: BrandiketMAX requires a 3-month minimum commitment unless otherwise stated in writing.
After the minimum term, services continue month-to-month until canceled in writing.

  • Cancellation requests received before the next billing date prevent the next cycle from being billed.
  • Nonpayment may result in paused work, removal of access, and/or termination.


9) Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages. The Company’s total liability for any claim related to services will not exceed the amount you paid to the Company for the services giving rise to the claim during the prior 3 months.


10) Governing Law / Venue

These Terms are governed by the laws of the State of Florida. Services are offered nationwide, and we may serve clients across the United States.
